Abstract :

Civil liability obligations in emergency situations play a crucial role in promoting social cohesion and safeguarding human rights, particularly through the lens of Islamic cultural principles and social trust. This study aims to conduct a comparative analysis of the influence of Islamic principles on civil liability obligations and to examine their relationship with social trust in the legal systems of Iran and Egypt. Employing a qualitative, non-survey, descriptive-analytical approach, data were collected through extensive library and documentary research. Findings indicate that in Iran, jurisprudential principles such as La Dharar (no harm) and Tasbib (causation), grounded in Article 1 of the Civil Liability Act of 1960 (1339 SH), form the foundation of civil liability obligations. However, the absence of explicit criminalization of failure to assist limits the practical enforcement of these obligations. In Egypt, Article 242 of the Penal Code strengthens the duty to rescue by criminalizing inaction, although technological challenges and limited access to emergency infrastructures in some regions hinder full implementation. The comparative analysis suggests that harmonizing Islamic jurisprudential principles with the development of emergency technologies and public education can reinforce rescue obligations, enhance social trust, and reduce human losses. Consequently, the study emphasizes the necessity of revising civil liability laws in Iran, enhancing technological capacities, and promoting a rescue culture rooted in Islamic principles.
