Analyzing the law on determining the citizenship of children born from the marriage of Iranian women with foreign men, approved in 2018, from the perspective of children's rights

Abstract :
"The right to benefit from citizenship" is one of the "fundamental human rights" that gives a person a legal identity, and basically, the realization of a person's rights depends on his citizenship being known; Because citizenship provides the practical possibility of enjoying one's rights; However, Iranian women married to foreign men were legally unable to apply for Iranian citizenship for their children under 18 years of age based on documents related to the civil law, and on the other hand, due to the statelessness of these children, who sometimes after the father fled and the identity was unknown He had negative consequences; such as deprivation of identity documents and consequently, deprivation of rights; Nazir found the right to health and education, "The Law on Determining the Citizenship of Children Resulting from the Marriage of Iranian Women with Foreign Men" was approved in 2019. in order to remove limitation and with the influence of international human rights, in 2018, the lawmaker approved the law amending the above-mentioned law in order to protect the status of Iranian women and provide the necessary legal grounds for fulfilling the rights of their children under the age of 18. Although granting citizenship to these children may be a positive step to reduce their injuries and problems, but due to the lack of transparency, the lack of assignment of some issues has created challenges.
