An Analysis of the Principles and Methods of Discovering the Intention of the Lawgiver in Religious Texts with Reference to Pragmatic Theories

Abstract :

The purpose of this study was to examine and analyze the principles and methods of discovering the intention of the Lawgiver in religious texts. Accordingly, the main research question is: "What are the principles and methods of discovering the intention of the Lawgiver in religious texts?" The research method is descriptive-analytical, and the findings reveal that there are four principles—the relationship between words and meanings, the breadth and elasticity of meaning, the transformation of certain concepts and subjects over time, and interpreting grammatical forms, structures, and vocabulary of religious texts in accordance with customary meanings—as well as seven methods for discovering the intention of the Lawgiver in religious texts. Most of these seven methods are shared among the peoples of different eras, including the present time, and those of the age of revelation. However, this does not mean complete equivalence, since these issues vary in degree. For instance, something that in one period, due to the limited scientific capacity of its people, appeared implausible may be readily accepted in another era. In our time, for example, accepting that the Imams (peace be upon them) were even free from any minor lapses of preference (tark awlā) or unintentional errors in their entirely personal behaviors entails no difficulty, whereas in their own time and even in the first centuries of the Greater Occultation, such a claim was regarded as highly improbable and unacceptable, and whoever asserted it was accused of exaggeration (ghulūw). This matter also applies to natural inclinations; for instance, the Arabs were known as a harsh and less emotional people, while their instinct of vengeance, which exists in all humans, was considerably stronger in them. Consequently, the Lawgiver was compelled to place greater emphasis on emotional matters and to repeatedly stress forgiveness and pardon of others’ faults. As for the fifth principle, namely "the discourse of the Shari‘a itself," although there are differences between our presuppositions and those of the addressees of the Lawgiver, understanding the discourse established by the Shari‘a is not particularly difficult, since this discourse was formed through verses and traditions that are also accessible to us today. For instance, understanding the presuppositions that the Prophet’s (peace be upon him) audience developed concerning congregational prayer and, consequently, how these presuppositions affected their understanding of Friday prayers and the prayers of the two Eids is not difficult. The last principle, however, namely "the requirements of time and place," is the most challenging aspect, as it necessitates a study of the Arabs’ lives, customs, and temporal and regional circumstances. This is precisely the task that must be pursued with the aid of the discipline of "history."
