Freedom of Citizens in the Internet from the View of Islamic jurisprudence and Law

Abstract :

The purpose of the present study is to review how much citizens are free to express their ideas on the internet, from the view of Islamic jurisprudence and law. The method of study is descriptive-analytic and the results indicate that Islam respects "freedom of speech" and has set its framework in some general aspects. The divine law which involves respecting the blessed name of God and His messenger should be considered in all aspects so every criminal act against that in the cyber space is regarded as a crime. From the view of Islamic penalty law, every criminal act that is recognized as a crime and the legislator has determined a penalty for that is involved in this framework so no one has a right to use the internet for such misconducts. Private rights are also included within these principles and no one has a right to use the internet to violate other people's privacy and deny their rights. Claiming rights is acknowledged for the loser part and the private rights of people in the cyberspace is quite respectable.
