Abstract :
Dissolving condition in contracts which is to observe contracting parties, rights and to assure the implementation of parties, commitments, has been reputably confirmed by Islam jurists, and the agreement of contracting parties about the interpolation of dissolving condition in contract is not inhibited conconcicelly. In some ceses, dissolving condition is to suspend or dissolve the contact. This has been confirmed by jurists because what necessitates the interpolation of dissolving condition in contract is the observesion of contracting parties' rights and the assurance of the implementation of their commitments. In most legel systems around the world, dissolving condition has been accepted and has been retered to it in law; only, the way of applying it is diffrenet some have predicated it outcome condition and conically, the violation of this condition spontonevsly dissolves the contract. Also, law, article 10 and aroud that in the case of the existence to dissolving condition in a contract, violation of the condition by the parties spontansously causes the dissolution of the contract. All legal systems in the world as well as international pratocols and conventions dominant in the world's countries have confirmed it.
