The Effectiveness of Knowledge and Lack of Knowledge in Worship, Transactions, and Criminal Laws

Abstract :
In the field of transactions, two main assumptions can be made: first, the assumption of knowledge regarding the general principles of transactions and second, the assumption of ignorance regarding the details and sub-sections. In this context, the realm of knowledge and ignorance covers a wide space, each of which has a significant impact on the decision-making process and the results of transactions. In other words, the musts that are necessary to be aware of and the musts that prevent ignorance on various issues. This article focuses on the issue of whether in transactions, the assumption is on the knowledge and knowledge of the parties and ignorance is considered without problems in certain circumstances or under what circumstances ignorance is considered an excuse and what type of ignorance can be accepted. This article also addresses issues such as ignorance in worship and criminal laws and attempts to examine different aspects of this issue. In this article, the research method is descriptive and analytical. The result is that it is stated in the texts of jurists that in examining the status ruling on the worship of an ignorant person, there are significant differences between the deficient ignorant and the culpable ignorant. The ignorant person, due to his negligence and failure to acquire knowledge, is considered to be the same as the scholar in terms of the ruling, and for this reason his acts of worship have no religious validity and are subject to reprimand and punishment. However, in the case of the ignorant person, the well-known opinion of the jurists regarding the ruling and the subject is that his act will be absolutely correct. Ignorance is usually accepted in transactions. In the field of criminal law, ignorance can lead to the fall of criminal liability and punishment.
