A Critique On The Iran Judicial Penalization System In Terms of Judicial assessment of the severity of the crime and Solutions to deal with it

Abstract :
The principle of proportionality between crime and punishment requires that, in addition to the legislative Penalization stage, in the judicial Penalization stage also the punishment determined must be proportionate to the severity of the crime. In order to comply with this principle, the judicial authority is obliged to assess the severity of the crime in each specific case, So that they can impose appropriate punishment based on it. In the Iranian judicial punishment system, the lack of comprehensive principles for the judicial assessment of the severity of a crime has led to the formation of inconsistent judicial procedures in this regard Which leads to the accidentalization of justice. Therefore, it seems necessary to establish a systematic procedure for judicial assessment of the severity of a crime in order to prevent dispersion in judicial sentencing. Although the legislator, in Article 18 of the Islamic Penal Code passed in 2013, sought to provide a way forward for judges by explaining some indicators of judicial assessment of the severity of the crime, Iran's judicial punishment system continues to face challenges in this regard. This article attempts to first explain such challenges and then present solutions to overcome them.
