Examining the enforceability of virtual account contracts in the Iranian legal system

Abstract :
We live in a world filled with technology. Every day millions of users enter the virtual world such as social medias emails، etc. and expose themselves to a world of unique information. We write e-mails، through virtual accounts، save pictures، videos and documents. Digital assets are quickly replacing physical letters، pictures and books. Due to the increasing growth of virtual space in our lives، it is necessary to fill the gaps in this field so that in the future، we will be able to meet the needs of the community. The nature of space is the first challenge in this field because by clarifying this issue، the next steps can be taken more consciously. Currently، there are three approaches to interpret the nature of the virtual account: property rights، contractual rights، and privacy. Proponents of the contractual approach believe that because the virtual account is created through a contract between the service provider and the user، it should be interpreted under the contract law rules. But these types of contracts are not enforceable because they are classified as adhesion contracts and it is against the law,public order and good morals.
