Abstract :

The issue of the environment is one of the most important and fundamental issues in the relations between governments and people, as well as between NGOs and governments. Today, the natural environment is under threat because, with the help of technology, humans are able to destroy the environment on the surface of the planet. Solidarity rights or the third generation of human rights require the efforts and cooperation of all countries in the world, and that is why the name solidarity is the most appropriate name for these rights. One of the rights included in the third generation is the right to a healthy environment. Undoubtedly, whenever pollution and destruction engulf the environment; The ground for contracting various diseases and, as a result, increasing mortality and reducing life expectancy will be a problem for that country and even its neighbors. In the meantime, environmental pollution itself is one of the fundamental factors in the field of people's health rights and related problems. From the perspective of the Iranian legislator, citizenship rights are a privilege that is given to citizens within the borders, but citizenship rights from the perspective of the environment cannot be limited to borders because the environment crosses borders. The perpetrator of the polluting act is called a violator of the environmental rights of citizens. Most behaviors that contradict the environmental rights of citizens are classified as crimes committed against living or non-living elements or indirect crimes against the environment according to the law. Pollution in any form, including visual, water, air, waste, etc., endangers the mental, emotional, and physical health of citizens and poses a serious threat to the most fundamental right of citizenship, which is the right to life and health. Therefore, the performance of specialized courts and prosecutors in the field of environment should be a barrier against violators of citizenship rights.
