Abstract :

Violence and especially sexual violence against women, ranks amongst the most common violations of human rights. Undoubtedly, this phenomenon, often perpetrated by men, poses a major cultural, social, economic, and political challenge to societies. The increase in the occurrence and diversity of sexual violence on one hand, and the existence of fundamental obstacles and problems in the path of women's rights enforcement, on the other hand, have prompted legal systems of countries to face with this increasing process and in order to decrease that, shows various reactions. One of the most general reactions of criminal law in Iran can be the establishment of specific and effective penal laws and regulations. It is obvious that the achievement to this objective of combating sexual crimes, except in light of recognition and accordance with other leading criminal laws upon the review and amendment of relevant laws and modeling the powerful points and constructive legal solutions, provided the necessary proportion with principles and cultural and social values accepted by public and overcoming any weaknesses is not possible. In this research, attempts to survey objectively the sexual violence against women in the criminal systems of Iran and England. The result obtained from comparing sexual violence in the penal laws of both countries reveals a shared perspective in the general criminalization of many instances of it, while also highlighting differences in criminal titles, the method of criminalization and the legislatures’ perspectives in examining penalties on offenders.
