Abstract :

Background and Aim: In this time, the functioning of pre-trial institutions has changed to some extent. As; These institutions no longer merely seek to prosecute defendants and gather evidence to prove a criminal case, but sometimes they have been given the opportunity to use a number of performance guarantees to respond to the crime. In fact, these institutions, which used to be only preparing criminal cases, these days, in addition to performing their traditional duties, are also taking steps to determine the fate of criminal cases in the pre-trial stage. This policy, which has led to the expansion of the mission of pre-trial institutions, has given rise to the "judgment of the pre-trial stage".Methodology: The present article has been written by descriptive and analytical methods.Findings and Conclusion: Judging the pre-trial stage means that prosecuting and investigating institutions, like the courts, can provide a rehabilitative, empowering and possibly remedial response on the occasion and according to the circumstances of the accused children and adolescents. Take action. In examining Iran's criminal law, it became clear that the legislature, based on the prohibitions set forth in international human rights instruments and the application of corrective and educational responses, have based their approach to correction and treatment on legislation. Of course, the variety and richness of corrective-educational responses prescribed for children and adolescents has not been significant.
