مسئولیت بینالمللی دولت حامی در بهرهبرداری از منابع ناحیه در پرتو بایستههای حقوق بینالملل محیط زیست

ملخص المقالة :
تعهدات دولت حامی، تابع مسئولیت ناشی از بایستههای حقوق بینالملل محیط زیست است. تعهدات دولت حامی در حفاظت از محیط زیست ناحیه دارای ماهیت مقتضی، ارزیابی، احتیاط، پیشگیری، کنترل و جبران است. با وجود این، اگر دولت حامی کلیه اقدامات لازم و مناسب در حد توان و امکانات خویش را برای پایبندی پیمانکار تحت حمایت انجام داده باشد، جبران خسارات ناشی از فعالیت پیمانکار برعهده آن نیست. این وضعیت بهمعنای جبران نشدن خساراتی است که ناشی از فعالیت پیمانکار برای بهرهبرداری از منابع ناحیه است. حال آنکه جامعه بینالمللی نباید خسارات وارد شده از فعالیتهای پیمانکار به محیط زیست دریاها را در هر صورت متحمل شود. بیتردید ناتوانی دولت حامی در کنترل و الزام پیمانکار به تبعیت مطلق از استانداردهای بینالمللی در اکتشاف و استخراج منابع دریاها نباید به حساب جامعه بینالمللی گذاشته شود. ضروری است که دولت حامی به نحو مطلق مسئولیت خسارات وارد شده از سوی پیمانکار را برعهده داشته باشد. اگر ورود خسارات ناشی از تقصیر پیمانکار است، دولت حامی آن را جبران کند و سپس از وثیقههای پیمانکار کسر کند. اگر ورود خسارات ناشی از سهلانگاری دولت حامی است، همو خسارت را جبران کند تا اینکه در هر صورت خسارات وارد شده به محیط زیست دریاها بدون جبران باقی نماند و صدمات آن بر پیکره جامعه بینالمللی تحمیل نشود.
