طلاق به عنوان یکی از مهم‌ترین نهادهای حقوق خانواده، در نظام‌های حقوقی مختلف با تفاوت‌های اساسی در مبانی، تشریفات و آثار حقوقی مواجه است. این مقاله به بررسی تطبیقی نظام حقوقی طلاق در ایران و ایالات متحده آمریکا می‌پردازد و تفاوت‌ها و شباهت‌های این دو نظام را از منظر مبانی قانونی، رویه‌های قضایی و چالش‌های اجرایی تحلیل می‌کند.
در ایران، طلاق تحت تأثیر فقه اسلامی و قانون مدنی، عمدتاً در اختیار مرد است، اگرچه در شرایط خاص، زن نیز می‌تواند درخواست طلاق دهد. در مقابل، در ایالات متحده آمریکا، طلاق بر مبنای اصول سکولار و در قالب طلاق بدون تقصیر (No-Fault Divorce) یا طلاق مبتنی بر تقصیر (Fault-Based Divorce) اجرا می‌شود. همچنین، این مقاله نقش محاکم در رسیدگی به دعاوی طلاق، مسائل مالی از جمله مهریه، نفقه و تقسیم اموال، و حقوق فرزندان از جمله حضانت و نفقه را بررسی می‌کند.
در نهایت، چالش‌های اجرای احکام طلاق در هر دو نظام حقوقی مورد تحلیل قرار گرفته و پیشنهادهایی برای اصلاحات حقوقی با هدف تأمین عدالت و حمایت از حقوق طرفین ارائه می‌شود. این مطالعه با بهره‌گیری از رویکرد تطبیقی، درک عمیق‌تری از نقاط قوت و ضعف هر نظام حقوقی در زمینه طلاق فراهم کرده و می‌تواند مبنای اصلاحات حقوقی در این حوزه قرار گیرد.
