مطالعه تطبیقی قوانین و مقررات مقابله با تروریسم از منظر اسلام و حقوق بین الملل

ملخص المقالة :
تروریسم در مقام یکی از مهم ترین معضل های امنیتی جهان معاصر، تاملات و پژوهش های قابل توجهی را در ساحات مختلف علوم انسانی از جمله حقوق بین الملل به خود اختصاص داده است . مطالعات اسناد مربوطه نشان می دهد که این پدیده با گسترش مناسبات جهان و در پی عدم توازن فزآینده طبقات اجتماعی و نابرابری های سیاسی رو به افزایش نهاده است. هدف از این پژوهش، بررسی موجبات پیدایش مقررات بین المللی و اسلامی در جهت مقابله با تروریسم از منظر حقوق بین الملل است که با روش توصیفی-تحلیلی انجام شده است. طبق نتایج حاصله علی رغم تصویب کنوانسیون های بین المللی و تعاریف و قوانین اسلامی و علاوه بر آن، تصویب قوانین درون ساختاری کشورها، دوران معاصر شاهد عدم توافق و توفیق جمعی در مقابله و امحای پدیده تروریسم بوده است. علت این امر را می توان در فقدان دستیابی به وحدتی نسبی در تعریف ماهیت و سرشت عمل تروریستی دانست که متعاقبا شکل های مقابله با آن و نهادهایی هم چون سازمان ملل متحد را نیز دچار سردرگمی و ناکارآمدی می سازد. ساختار حقوق بین الملل نیز هر چند در ایجاد قوانین و مقررات بین المللی توفیقاتی داشته ، اما به دلیل اعمال قدرت از سوی دولت ها قدرتمند در جهت منافع شان این تدبیرها بدل به راهکارهای ثمربخش و نهایی نشده است
