Investigating the social legal dimensions of consensual divorce of young couples in Iran

Abstract :
The change and transformation in today's lifestyle, the progress and modernization of society, the expansion of communication and social networks, and the connection with many groups of today's lifestyle, have also affected the beginning and ending of lives. Divorce by agreement is one of the almost new examples of divorce in today's society, which has been studied and researched in this field in recent years. In this article, the legal and social aspects of consensual divorce in Iran are investigated in a library and descriptive analytical method.The findings indicate the absence of a clear and specific definition of consensual divorce and its nature, the increase of consensual divorce statistics, the existence of legal defects in the certificate of impossibility of compromise, and the lack of executive guarantee and sufficient supervision for some consensual divorce provisions. The jurists have agreed that a consensual divorce is a divorce, and the acquisition of any kind of property or privilege that is obtained as a result of this issue is illegal and considered haram, and it is also criminalized in Iranian law. Therefore, consensual divorce has dimensions and social and legal consequences among young couples.
