بررسی و تحلیل برخی اصلاحات پریخانیان در تصحیح نسخه مادیان هزار دادستان

مادیان هزار دادستان تنها نسخه خطی ناقص موجود از چندین مجموعه حقوقی دوره ساسانیان، اصطلاحات حقوقی بسیاری را دربر دارد که برای متخصصان فقه و حقوق نوشته شده است و توضیحی برای اصطلاحات کتاب داده نمی‌شود. پریخانیان، ایران‌شناس روسی، این نسخه را به طور کامل مطابق صفحه و سطر ترجمه کرده است. با ارج‌گذاری به پژوهش پریخانیان، که در بررسی‌های بعدی بسیار راه‌گشا بوده، نگارنده با برخی از اصلاحات او موافق نیست. پرسش مقاله این است: آیا تصحیح انجام شده نسخه ارزشمند مادیان نباید مورد بحث و تبادل نظر سایر پژوهشگران این حوزه قرار بگیرد؟ رعایت امانت‌داری از اصول مهم در تصحیح نسخه است. هر تغییر جزیی در این مجموعه ممکن است ابهام حقوقی پدید آورد. ده مورد از تصحیحاتی که پریخانیان انجام داده بود، انتخاب شد تا نشان داده شود، سند اصلی نسخه است؛ جهت امانت‌داری باید هر تغییری در تصحیح با احتیاط انجام شود و نباید دست در املای نسخه ببریم، چون بیان قانونگذار را متوجه نمی‌شویم. دختر را به پسر تصحیح کنیم یا نهِ نفی را برداریم و جمله را مثبت معنی کنیم یا جمله مثبت را به جمله منفی تبدیل کنیم و سایر. این گفتار با روش توصیفی‌تحلیلی به برخی عدم موافقت‌ها با تصحیح پریخانیان می‌پردازد.
Mādigān i Hazār Dādistān is the only defective manuscript of the legal collection of the Sasanian period. It contains many legal terms written for jurisprudence and law experts. And no explanation is given for the idioms of the book. Perikhanian a Russian Iranian scholar, has completely translated this manuscript according to page and line. With regard to Perikhanian's research, which has been very helpful in subsequent reviews, the author of this article does not agree with some of her reforms. The question of the article is: Shouldn't the correction of the valuable version of the Mādigān be discussed and exchanged with other researchers in this field? Observance of trustworthiness is one of the important principles in proofreading. Any minor change in this collection may create legal ambiguity. Ten of the corrections Perikhanian made were selected until to be shown, the original document is the manuscript. To comply with fiduciary, any change in the correction should be done carefully and we should not touch the spelling of the manuscript, since we do not understand the expression of the legislator.We should not correct a girl to a boy or change the negation and make the sentence positive or turn the positive sentence into a negative sentence and etc. This article deals with some objections to Perikhanian's correction with a descriptive-analytical method.
