چکیده مقاله :
این مقاله تلاش دارد به تحلیل تأثیر سیاست‌های ایالات متحده آمریکا بر نظام حقوق بین‌الملل در خاورمیانه، با تمرکز ویژه بر ایران و عراق، می‌پردازد. هدف اصلی این تحقیق، بررسی تطبیقی سیاست‌های ایالات متحده در قبال دو کشور مذکور و ارزیابی پیامدهای حقوقی آن‌ها بر اصول بنیادی حقوق بین‌الملل است. این اصول شامل حاکمیت ملی، ممنوعیت استفاده از زور، و اصول مربوط به تحریم‌ها و مداخلات نظامی می‌باشد. با استفاده از روش تحقیق توصیفی-تحلیلی، مقاله به تحلیل اسناد بین‌المللی، قطعنامه‌های سازمان ملل، و گزارش‌های حقوق بشری پرداخته و پیامدهای حقوقی سیاست‌های ایالات متحده در دوره‌های مختلف را از منظر حقوق بین‌الملل ارزیابی می‌کند. در این راستا، تحلیل موردی سیاست‌های ایالات متحده در عراق از زمان حمله نظامی در ۲۰۰۳ و تحریم‌های اقتصادی علیه ایران به‌ویژه پس از خروج این کشور از برجام، محورهای اصلی تحقیق را تشکیل می‌دهند. نتایج این تحقیق نشان می‌دهند که سیاست‌های یک‌جانبه‌گرایانه و مداخلات نظامی ایالات متحده منجر به نقض اصول حقوقی بنیادین، تضعیف نهادهای بین‌المللی و افزایش بی‌اعتمادی در نظام حقوق بین‌الملل شده است. این مقاله به‌طور خاص بر لزوم بازنگری در سیاست‌های ایالات متحده و حرکت به سمت رویکردهای مبتنی بر همکاری‌های چندجانبه و احترام به حاکمیت ملی و حقوق بشر تأکید دارد.
This article analyzes the impact of US policies on the international legal system in the Middle East, with a special focus on Iran and Iraq. The main objective of this research is to conduct a comparative study of US policies towards the two countries and assess their legal consequences on the fundamental principles of international law. These principles include national sovereignty, the prohibition of the use of force, and the principles related to sanctions and military interventions. Using a descriptive-analytical research method, the article analyzes international documents, UN resolutions, and human rights reports and evaluates the legal consequences of US policies in different periods from the perspective of international law. In this regard, a case study of US policies in Iraq since the military invasion in 2003 and economic sanctions against Iran, especially after the country’s withdrawal from the JCPOA, constitute the main axes of the research. The results of this research show that unilateral policies and military interventions of the United States have led to violations of fundamental legal principles, weakening international institutions, and increasing distrust in the international legal system. This article specifically emphasizes the need to review US policies and move towards approaches based on multilateral cooperation and respect for national sovereignty and human rights.
