چکیده مقاله :
در خصوص قابلیت ثمن یا مثمن واقع شدن حقوق در عقد بیع میان فقها و حقوقدانان سه نظریه وجود دارد : 1) عده ای نقل و انتقال حقوق را به طور کلی نپذیرفته اند و صرفا آن را مختص نقل و انتقال اعیان می دانند. 2) عده ای دیگر نقل و انتقال حقوق را پذیرفته اند. 3) گروه سوم قائل به تفصیل شده اند. بدین نحو که، میان معاوضه نفس حق و معاوضه بر اسقاط حق فرق گذاشته اند و معاوضه بر اسقاط حق را پذیر فته اند. در تحقیق حاضر با روش توصیفی تحلیلی کیفی محتوا با عنایت به ادله ارائه شده نتایج حاصله تحقیق نشان می دهد که تعبیر مال به عین نزد متاخران برای اخراج اجاره از تعریف بیع بوده و رویه قضایی هم اشاره به همین امر دارد و بر خرید و فروش حق نیز تعریف بیع صادق است و حقوق همچنین می تواند جای عوض قرار گیرد و ادله صحت بیع نیز بر این امر دلالت می کند.
